1. Purpose of the Service

Rive is a software-as-a-service (SaaS) platform designed to **assist** restaurant owners and managers in their daily operations, including:

  • Digital logbook maintenance
  • Temperature monitoring and corrective action suggestions
  • Multilingual service note translation
  • Food cost analysis and menu engineering
  • Delivery receipt digitization through optical recognition
  • AI-assisted social media content generation

2. Access and Registration

**2.1.** The user must create an account with a valid email address to access the service.
**2.2.** The user is responsible for the confidentiality of their login credentials.
**2.3.** A 14-day free trial is offered without a credit card. Beyond that, a paid subscription is required to continue using the service.

3. Specific Clause — Artificial Intelligence and Liability

3.1. Nature of AI-generated suggestions

The Rive service integrates artificial intelligence technologies (LLM models) provided by third parties (Anthropic / Claude). These technologies are used to:

  • Analyze and categorize service notes
  • Suggest corrective actions when abnormalities are detected
  • Translate content between supported languages
  • Extract data from receipt images
  • Generate textual content for social media
  • Analyze food cost data

3.2. Warranty limitation on AI suggestions

Suggestions, analyses, and content generated by the AI integrated into Rive are provided for informational and indicative purposes only.

The user acknowledges and accepts that:

  • **AI suggestions do not constitute professional advice** regarding food safety, regulatory compliance, public health, or any other professional discipline.
  • **AI suggestions are not a substitute** for the judgment of a qualified professional, accredited health inspector, or any other competent expert.
  • **AI may produce inaccurate, incomplete, or inappropriate results.** Due to the probabilistic nature of the language models used, results may vary from one execution to another for the same input (non-deterministic behavior).
  • **Final responsibility for any operational decision**, including but not limited to corrective actions, health compliance decisions, internal communications, and external publications, **rests exclusively with the user** and the qualified personnel of the establishment.
  • **Rive does not guarantee regulatory compliance** of the user's establishment. The service is designed to *facilitate* and *assist* compliance management, without guaranteeing it.

3.3. User Obligation to Verify

  • **Verify and validate** any AI-generated suggestion before applying it in operations.
  • **Do not rely exclusively** on AI suggestions for decisions impacting food safety or public health.
  • **Maintain required regulatory skills and training** for personnel, independent of using the service.
  • **Report** any clearly inappropriate or potentially dangerous suggestion to the Rive team.

3.4. Automatic Translations

AI-generated translations are provided for indicative purposes. Rive does not guarantee the accuracy, completeness, or suitability of translations, particularly for safety-related communications. Users are encouraged to have critical translations verified by a qualified native speaker.

3.5. Data Extraction (OCR)

Data automatically extracted from images (receipts, invoices) may contain errors. The user is responsible for verifying the accuracy of amounts, dates, supplier names, and other extracted data before integrating them into their accounting or operations.

4. Personal Data Protection

**4.1.** Rive collects and processes personal data in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, Quebec's Law 25.
**4.2.** Data entered by the user (notes, temperatures, receipts) is securely stored on servers hosted by Supabase (cloud infrastructure).
**4.3.** Data transmitted to third-party AI services (Anthropic) for analysis is subject to the privacy policies of said providers. Rive commits to minimizing the personal data transmitted.
**4.4.** The user retains ownership of all data they enter into the service.

5. Limitation of Liability

**5.1. Rive is provided 'as-is' and 'as-available'.** Rive does not guarantee that the service will be error-free, uninterrupted, or suitable for a particular purpose.
**5.2.** In no event shall Rive, its officers, employees, or providers be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the service, including but not limited to:

  • Financial losses resulting from inaccurate AI-generated data
  • Regulatory sanctions resulting from excessive reliance on service suggestions
  • Food or operational losses related to AI-suggested corrective actions

**5.3.** Rive's total liability to the user is limited to the amount of subscription fees paid by the user during the 12 months preceding the event giving rise to the claim.

6. Intellectual Property

**6.1.** The Rive service, including its source code, design, algorithms, and documentation, is protected by intellectual property laws.
**6.2.** The user retains all rights to the content they enter into the service (notes, menus, images).
**6.3.** Content generated by the AI at the user's request (social media posts, summaries, translations) is made available to the user for their commercial use, without restriction.

7. Termination

**7.1.** The user can terminate their subscription at any time via their account settings.
**7.2.** Upon termination, the user will be able to export their data for a period of 30 days.
**7.3.** Rive reserves the right to suspend or terminate a user's access in case of violation of these conditions.

8. Changes to Conditions

**8.1.** Rive reserves the right to modify these conditions at any time. Users will be informed of any substantial modification by email or in-app notification.
**8.2.** Continued use of the service after notification of a change constitutes acceptance of the new conditions.

9. Governing Law and Jurisdiction

These conditions are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute will be submitted to the exclusive jurisdiction of the courts of the Province of Quebec, District of Montreal.
